- Agreement to Terms
By using our video production services, you agree to be bound by these Terms of Service, as well as any additional terms and conditions that are referenced herein or made available to you in connection with our services.
- Service Description
We provide video production services, which include but are not limited to: pre-production planning, scripting, filming, editing, post-production, animation, and other related services as mutually agreed upon between Eggplain.com and the client.
- Client Responsibilities
a. The client shall provide all necessary materials and information required for the production process, including logos, branding guidelines, scripts, images, and any other relevant content.
b. The client shall adhere to agreed-upon timelines and deadlines for providing feedback, approvals, and any other required information.
c. The client shall ensure that all provided materials do not infringe upon any copyrights or trademarks, and holds the necessary rights and licenses for their use in the video production.
- Intellectual Property
a. All intellectual property rights, including copyrights, trademarks, and other proprietary rights, in the final video production belong to Eggplain.com, unless otherwise agreed upon in writing.
b. The client may use the final video production for its intended purposes, as specified in the project scope, without altering or modifying the content.
- Payments and Fees
a. The client shall pay all fees and charges associated with the video production services as outlined in the project proposal or agreement.
b. Payments shall be made according to the agreed-upon payment schedule, and any late payments may incur additional charges or suspension of services.
- Cancellation and Refunds
a. If the client wishes to cancel a project, a written notice must be provided. Depending on the project stage, a cancellation fee may apply.
b. Refunds, if applicable, will be subject to the terms specified in the project proposal or agreement.
- Confidentiality
All information provided by the client and any project-related discussions or materials shall be treated as confidential and will not be disclosed to third parties without the client’s consent, except as required by law.
- Disclaimer of Liability
Eggplain.com shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages resulting from the use or inability to use our video production services.
- Indemnification
The client agrees to indemnify and hold Eggplain.com harmless from any claims, damages, losses, liabilities, and expenses arising from the client’s use of the video production services or breach of these Terms of Service.
- Governing Law
These Terms of Service shall be governed by and construed in accordance with the Indonesian laws. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Indonesia.
